(1) Regardless of what is written in this Act, in the event that no choice has been made even after calling for letters of intent or proposal at least twice, the concerned body may implement the project directly through negotiation.
(2) Notwithstanding anything written in sub-section (1), if for any of the following reasons it is deemed necessary to implement a project through negotiation, the concerned body may execute the project through negotiation after completing the prescribed process:-
(a) A project that is not likely to be economically and technically competitive due to the nature or cost of the project (b) A project involving a new concept or technology,
(c) Projects chosen to be implemented on the basis of national priorities,
(d) Projects that are not suitable for adopting other procedures according to this Act.
(3) The proposer who wants to implement a project under sub-section (1) through negotiation shall submit the proposal to the relevant body after clarifying the prescribed matters.
(4) After detailed evaluation of the proposal under sub-section (3) as specified, the concerned body may give approval to implement the project through negotiation.
